Title IX Compliance

Title IX of the Education Amendments of 1972 is a federal law that prohibits sex discrimination in education it reads:

"No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance." --Legal Citation: Title IX of the Education Amendments of 1972, and its implementing regulation at 34 C.F.R. Part 106 (Title IX)

Barry University prohibits discrimination on the basis of sex. Sex discrimination includes sexual harassment and sexual assault, this includes: unwelcome sexual advances, requests for sexual favors, and other physical, verbal, or visual conduct based on sex constitute sexual harassment when (1) submission to the conduct is an explicit or implicit term or condition of employment or education, (2)submission to or rejection of the conduct is used as the basis for an employment or educational decision, or (3) the conduct has the purpose or effect of unreasonably interfering with an individual’s work performance, education or creating an intimidating, hostile, or offensive working or educational environment. Sexual harassment is conduct based on sex, whether directed towards a person of the opposite sex or same sex, and may include explicit sexual propositions, sexual innuendo, suggestive comments, sexually oriented “kidding” or “teasing,” “practical jokes,” jokes about obscene or visual material, and physical contact such as patting, pinching, or brushing against another person’s body.

All University employees and students are responsible to help assure that we avoid any form of sex discrimination or harassment. If you feel that you have experienced or witnessed harassment, you must notify the Title IX Coordinator or one of the Deputy Coordinators designated below. Barry University forbids retaliation against anyone for reporting harassment, assisting in making a harassment complaint, or cooperating in a harassment investigation, it is also a violation of Federal law.

If you have a complaint against a Barry University student for sexual harassment, sex discrimination, sexual assault, or stalking you should contact the Associate Vice President for Mission and Student Engagement and Dean of Students. The Associate Vice President is responsible for Title IX compliance for matters involving students, including training, education, communication, and administration of the grievance procedure for all Title IX complaints against Barry University students.

Gender Equity in Athletics

If you have a complaint about gender equity in Barry University athletic programs, you should contact the Senior Associate Athletic Director who is responsible for Title IX Compliance in matters related to gender equity.
