Official Rules and Regulations
The Rules and Regulations of Barry University’s cruise prize are set forth below, and all ticket holders agree to be bound by these rules and regulations. This ticket is administered by and is for the benefit of Barry University’s interpretation, and application of these rules and regulations shall be final.
How to Enter
Tickets sales begin on February 19, 2015, and conclude on April 17, 2015, at the Ryder-Benjamin Golf Tournament. Official entry forms must be legibly completed in their entirety with your name, permanent address, email address, and telephone number in order to be eligible. Only official entries are eligible for the drawing. Entries may be obtained in the following ways:
Mail: Download and complete our PDF Participation Form and return to Barry University, Division of Institutional Advancement, 11300 NE 2nd Avenue, Miami, FL 33161. Barry University is not responsible for prompt delivery by the United States Postal Service. Please allow five business days for U.S. Postal Service delivery of ticket entries.
Tickets are $100 for one and three for $250 (suggested donation) with all denominations in U.S. dollars. No purchase or contribution necessary. Only one eligible person per ticket may be entered in the prize. If the name of more than one person is submitted with a ticket and that ticket is selected as a winning ticket, then the person named first will be deemed the ticket holder of record of that ticket and declared the winner. Division of the prize by a group obtaining a ticket in common shall be the sole responsibility of the person named as the holder of record of that ticket.
Barry University reserves the right to disqualify any ticket purchased with payment that does not constitute “good fund.” Prior to the prize drawing, Barry University will make a reasonable effort to notify any purchaser whose ticket(s) has been disqualified by attempting to make contact through the contact information provided by the purchaser.
Barry University assumes no responsibility for lost, late, misdirected or non-delivered mail, fax messages, email messages, or any other failure to receive reservations or deliver receipts prior to the applicable ticket deadline established herein.
How The Winner Will Be Selected
The winner will be selected in a random drawing on Friday, April 17, 2015, at Barry University’s 2015 Ryder-Benjamin Golf Tournament at Crandon Golf at Key Biscayne. One alternate winner will be selected, who will be awarded the prize in the event that the first winner does not validly, and timely, claim the prize. The winner is the person whose name appears on the first ticket stub drawn. The alternate is the person whose name appears on the second ticket stub drawn. The winner need not be present to win. The winner will be notified, according to the contact information provided to Barry University at the time the ticket was purchased, on April 17, 2015, via telephone and/or email. If the prizewinner cannot be located after Barry University has made a reasonable effort to make contact, or should the prizewinner not take delivery of their prize within 14 days of the prize drawing date, the prize will be awarded to the alternate. In addition to the efforts to make direct contact as described above, the name of the winner will be posted to and publicly displayed on the Barry University website. Entry in the prize constitutes permission to Barry University to use winner’s name and likeness for publicity purposes.
The Barry University cruise prize is open to legal U.S. residents who are 18 years of age or older at the time of reserving of tickets.
The prize has no cash value and is non-transferrable. The prize is “cruise only” and therefore airfare, ground transportation, travel visas, hotels, shore excursions, gratuities, and any purchases of a personal nature are not included and are payable by the winner.
The prize is a 10-day cruise for two to Alaska leaving from Vancouver and returning to San Francisco aboard the M/S Regatta. The cruise must be taken on August 23, 2015. If winner fails to sail within the given timeframe, then the cruise will be forfeited and no extensions will be granted.
The cruise will be provided by Oceania Cruises and is subject to the terms and conditions of the Ticket/Contract. Berthing assignment will be in a Category A1 stateroom. An upgrade may be possible to purchase provided space is available but not guaranteed. Upgrades are not complimentary and can only be acquired through the Donation Coordinator.
Winner is responsible for all applicable taxes.
General Terms and Conditions
The IRS has taken the position that amounts paid for chances in prizes, lotteries, or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charitable contributions.
By entering this contest, entrants accept and agree that they shall be bound by all the rules, limitations, and restrictions set forth herein. Other rules and regulations may apply. Please contact Barry University if you have any questions.
By entering this contest, each participant releases Barry University, its directors, officers, employees, and agents from any and all liability for injuries, losses, or damages of any kind caused by participating in the contest or winning the prize or resulting from acceptance, possession, use, or misuse of the prize, and the winner agrees to indemnify and hold Barry University harmless from any and all losses, damages, rights, claims, and actions of any kind arising in connection with or as a result of participating in the contest or the winner’s acceptance or use of the prize.
