At Barry University, including our centers, schools, and affiliates (“University,” “we,” “us,” or “our,”), we respect and value the privacy of all individuals who use our websites, products, and services, including but not limited to academic advising, admissions, educational programs, career centers, research, community service, health centers, medical care, food services, and other services provided by the University (the “Services”).

We believe in transparency and want you to understand what Personal Information we collect from you and what control you have over that Personal Information. This Barry University Privacy Statement (“Statement”) describes, in general terms, how we collect your Personal Information, why we collect your Personal Information, how we use or share your Personal Information, and what control you have over your Personal Information. This Statement also contains links to relevant supplemental privacy notices and policies in specific areas.

Scope of this Privacy Statement

This Statement covers all individuals who are natural persons (not a corporation, partnership, or other legal entity) and the University handles their Personal Information. This Statement applies to the Personal Information handling activities of all members of the University community including all faculty, staff, students, third-party contractors, vendors, volunteers, and agents and members of the public who are engaged in University Services and/or have access to Personal Information obtained as part of University Services.

Our websites contain links to other non-Barry University websites or services, such as third party integrations, co-branded services, or third party- branded services. By visiting these third-party websites, you may be providing your information, including Personal Information, directly or indirectly to the third-party website owners and operators. Barry University does not process Personal Information collected by them and is not responsible for the privacy practices and/or the content of such third-party websites. Please note that these websites may have their own privacy statements and be sure to check the individual privacy statements of those websites.

Additionally, we are not responsible for the privacy practices and/or content of any third-party websites, even if Barry University’s brand appears on their page. Barry University has no control over the information gathered by those websites and is not responsible for any information collected by such websites.

Personal Information Collected or Received

When you use our Services, we collect or receive your Personal Information in different ways.

Generally, “Personal Information” is any information that relates to an identifiable person and may be defined more specifically by applicable laws and regulations. For example, if you are located in the European Economic Area (“EEA”) or United Kingdom (“UK”) “Personal Information” includes all “personal data” as defined in the European Union General Data Protection Regulation or UK General Data Protection Regulation, respectively. Personal Information does not include information that has been fully anonymized to make it impossible to identify specific natural persons and impossible to restore.

At times, you may choose what Personal Information you want to provide to us. We also obtain Personal Information automatically when you browse through our websites. There are three general categories of Personal Information we collect, as described below.

Personal Information Collected or Received

  • We collect Personal Information you share with us while using our Services. In order to provide you our Services, we may ask for and collect Personal Information about you. The type(s) of Personal Information we collect vary depending on the Services you use and may include but are not limited to:

    • Account information: A BarryU account is a username and password authentication process that provides access to multiple University systems and Services via use of that username and password. When you sign up for a BarryU account, we use Personal Information we previously collected from you (e.g., from your enrollment or employment application), such as your Social Security number, first name, last name, permanent address, email address, and date of birth, in order to verify and create your BarryU account.
    • Appointment information: When you submit an online appointment request, Barry University may use any Personal Information provided by you.
    • Payment information: In order to pay any outstanding bills to the University, or to pay for certain Services, we may require you to provide certain financial information, such as your bank account or credit card information, in order to facilitate the processing of payments and comply with applicable law.
    • Communications with Barry University and others: When you communicate with the University or use the University websites to communicate with others, those platforms may collect information about your communication and any information you choose to provide. This may be communications made through direct messages, message boards, forums, and/or new groups available to you. Please remember that information disclosed by you or others in certain message boards, forums, or groups, is not private and becomes public information. You should exercise caution when deciding to disclose your Personal Information in these or similar areas of our websites and applications.
    • Other information: You may otherwise choose to provide us Personal Information when you fill out a form, fill out an application, ask a question, conduct a search, respond to surveys, update or add information to your BarryU account, participate in promotions, or use other features of the University’s websites or Services.
  • Like most other website operators, the University uses cookies and similar technologies to automatically receive and record information, including Personal Information, from your browser or mobile device when you visit our websites.

    Along with your IP address, we use cookies and similar technologies to automatically collect information, including Personal Information, regarding which pages you access on our websites, access dates and times, content you view, actions you take, searches you make, information about which page led you to our websites, and the software you use to visit our websites. 

    We may also automatically collect device-specific information when you install, access, or use our websites or applications. This information may include information such as the hardware model, operating system information, app version, app usage, debugging information, browser information, and unique device identifiers.

  • We may collect information, including Personal Information, which others provide about you when they use our Services, or obtain information from other sources and combine that with information we collect from you through our Services.  We do not control or supervise the privacy practices of third parties that provide information to us, and any questions or requests regarding their handling of your Personal Information should be directed to those third parties.

    Information we collect from third parties varies depending on the Services you use and may include, but is not limited to:

    • Background information: For individuals in the United States, to the extent permitted by applicable laws, we may obtain reports from public records of criminal convictions or sex offender registrations. For individuals outside of the United States, to the extent permitted by applicable laws and with your consent where required, we may obtain the local version of police, background, or registered sex offender checks. We may use your information, including your full name and date of birth, to obtain such reports.
    • Other sources: We may collect or receive additional Personal Information about you, such as demographic data, from third party service providers, business associates, public or private databases, and/or organizations that may sponsor or facilitate your participation in our Services, and we may combine it with information we have about you.

How We Use Personal Information We Collect

We primarily use, store, and otherwise process information, including Personal Information, about you to provide, secure, protect, understand, improve, market, and develop our websites and Services and to comply with our legal obligations.

The purposes for which we process Personal Information vary depending on the type(s) of Services you receive and may be described in greater detail in the statements linked under the “Other Privacy Statements and Rights” section of this Statement.

In most cases, we use your Personal Information when necessary to fulfill a legitimate interest of the University in furtherance of its mission or to fulfill statutory duties or responsibilities, for example to comply with state and federal obligations. Other bases for the lawful processing of Personal Information may include the existence of a contractual relationship between you and the University and where you have given your consent.

How We Disclose Personal Information We Collect

How we disclose your Personal Information varies depending on the Services you use. Circumstances under which we may disclose your Personal Information include but are not limited to:

  • We disclose Personal Information to employees, including faculty, researchers, medical staff, financial aid counselors, human resources staff, law enforcement officers, and others associated with the University in order to carry out activities in furtherance of our Services and mission.  We may also disclose Personal Information to organizations related to the University, such as higher education enrollment management, analytics, and consulting service providers.

  • Where you have provided consent, we share your information, including Personal Information, as described at the time of consent, such as when you participate in promotional activities conducted by the University’s partners or third parties.

  • We may disclose your information, including Personal Information, to courts, law enforcement or governmental authorities, or authorized third parties, if and to the extent we are required or permitted to do so by law, court order, or other legal process, or if such disclosure is reasonably necessary:

    • To comply with our legal obligations.
    • To comply with legal processes and to respond to claims asserted against Barry University.
    • To respond to verified requests relating to a criminal investigation or alleged or suspected illegal activity or any other activity that may expose us, you, or any other of our users to legal liability.
    • To enforce and administer our Terms of Use, our payment terms, or other agreements.
    • To protect the rights, property, or personal safety of Barry University, its employees, its users, or members of the public.
    • To exercise Barry University’s legal rights or establish or defend legal claims.
  • Barry University uses third-party service providers to help us provide our Services and otherwise carry out activities in furtherance of our mission. Examples include service providers who help us:

    • Conduct background or police checks, fraud prevention, and risk assessment.
    • Perform product development, maintenance, and debugging.
    • Allow the provision of services through third party platforms and software tools (e.g., through the integration with our APIs).
    • Provide customer service, advertising, or payments services.

    These providers have limited access to your information to perform these tasks on our behalf and are contractually bound to protect it and to use it only for the purposes for which it was disclosed.

  • We may provide anonymized information developed from Personal Information to third parties.  Such anonymized information, which cannot be used to identify specific natural persons, is outside the scope of this Statement.

  • We may conduct cross-border transfers of Personal Information to, from, and within the United States and other jurisdictions where data protection laws may differ from those of an individual’s home country and where certain regulatory bodies, such as the European Commission and United Kingdom Information Commissioner’s Office, have determined local laws, regulations, policies, and other requirements do not ensure an adequate level of protection of Personal Information.

Children Under Age 13

Barry University does not knowingly collect online Personal Information from children under 13 years of age without prior parental consent or parental notification.

Your Rights and Choices

As provided under applicable law and subject to any limitations in such law, you may have certain rights and choices with respect to your Personal Information. Your rights and choices will vary depending on the laws and regulations that apply in relation to the Services the University provides to you, and they may be described in greater detail in the statements linked under the “Other Privacy Statements and Rights” section of this Statement.

You may exercise any of the rights and choices applicable to you by sending an email to privacy@barry.edu. Please note that we may ask you to verify your identity before taking further action on your request.

Security

If you know or have reason to believe that your BarryU account credentials have been lost, stolen, misappropriated, or otherwise compromised, or in case of any actual or suspected unauthorized use of your BarryU account, please contact Barry University Help Desk, helpdesk@barry.edu, 305-899-3604 or the Information Security Office at iso@barry.edu, 305-899-3604.

Unfortunately, no method of transmission over the internet or method of electronic storage is 100 percent secure. Therefore, we cannot guarantee the absolute security of information, including Personal Information, we collect and otherwise process.

If you are a Barry University student, you have privacy rights under the Family Education Rights and Privacy Act (FERPA).

HIPAA

If you are a Barry University (non-student) patient, you have privacy rights under the Health Insurance Portability and Accountability Act (HIPAA).

EEA GDPR and UK GDPR

If you are located in the EEA or UK, or if we process your Personal Information in the context of activities subject to the EEA GDPR or UK GDPR, you may have additional privacy rights under applicable law, including rights related to access, correction, deletion, restriction of processing, objection to processing, and data portability. Barry University may provide additional jurisdiction-specific privacy notices or supplements as they become available.
