Text Messaging Terms and Conditions

Barry University, Inc. ("Barry," “University,” "we," "our," “us,” “sending party”) offers complimentary SMS/MMS/Text update services (each a “Messaging Service,” and collectively the "Messaging Services") to prospective students, applicants, current students, alumni, and other members of the Barry community (the "Subscriber" or “you”). The Messaging Services are intended to provide information about recruitment, admissions, enrollment, student services, alumni engagement, University events, and/or other University-related updates.

Opting in to these Messaging Services is entirely voluntary. You are not required to opt in to any Messaging Service in order to apply to Barry University, attend Barry University, or receive any of our other goods or services.

By opting in to one or more of these Messaging Services, you expressly consent to receive informational, promotional, and/or marketing text messages from Barry University and its representatives (e.g., third-party marketing or recruitment service providers), including through automated technology such as auto-dialers or artificial intelligence (“AI”)-assisted responses, at your telephone number(s) you provide. Your participation is governed by these Barry University Text Messaging Terms and Conditions (“Messaging Terms & Conditions”).

Eligibility

  • The Messaging Services are not available to persons under thirteen (13) years of age.
  • Persons at or over thirteen (13) years of age and under eighteen (18) years of age must obtain parental or guardian permission before opting in to any Messaging Service.
  • By opting in, you confirm you are either:
    • eighteen (18) years of age or older, or
    • thirteen (13) years of age or older with your parent’s or guardian’s permission.
  • By opting in, you represent and warrant that you are the owner, or authorized user, of the mobile device you use to receive the Messaging Services or to send text messages to us.

Use of Messaging Services

  • Upon opting in to one or more of our Messaging Services, you will receive messages related to recruitment, admissions, current student services, alumni engagement, and/or other official Barry University information. The subject matter of the messages you receive will be specified at the time you decide whether to opt in and will vary depending on the Messaging Services you opt in to receive. 
  • Some responses may be generated in whole or in part using AI-assisted technologies. These responses are intended to supplement, not replace, direct human communication.
  • Frequency of messages may vary but will not exceed five (5) messages per month unless otherwise specified at opt-in.
  • Standard message and data rates may apply. Please check with your mobile carrier for details about your messaging and data plans and applicable rates. Additionally, your carrier may impose message or charge limitations on your account that are outside of our control. All charges are billed by and payable to your carrier. Barry University does not charge or collect any fee for your use of the Messaging Services.

Opt-In and Opt-Out

  • To opt in to a Messaging Service, follow the instructions provided on Barry University websites, forms, or official communications.
  • To stop receiving messages from a Messaging Service you have subscribed to, text "STOP" to the short code or number provided at any time. We reserve the right to send you a confirmation message upon successful unsubscribe.
  • To receive help or instructions, text "HELP" to the short code or number provided.
  • Opting out of a Messaging Service does not unsubscribe you from other Messaging Services or other Barry University services or communications you may have separately enrolled in.

Privacy and Data Use

  • Information you provide through these Messaging Services will be used in accordance with Barry University’s Privacy Statement, which describes our collection, use, and disclosure of personal information.
  • By opting in to one or more of the Messaging Services, you acknowledge that you have read and agree with Barry University’s Privacy Statement.

Messaging Services Disclaimer

  • These Messaging Services are provided "as is" without warranties of any kind.
  • Barry University does not guarantee timeliness, accuracy, or completeness of the information provided, including AI-assisted responses.
  • The Messaging Services are intended as a supplemental communication method and do not replace your responsibility for meeting deadlines, requirements, or other University obligations.
  • Delivery is subject to carrier availability. Barry University is not responsible for delivery failures due to mobile network conditions beyond its control.

Limitation of Liability

  • Barry University and its trustees, officers, employees, and agents disclaim liability for incidental, indirect, or consequential damages arising from use of these Messaging Services.
  • Text messaging is not always predictable. In some instances, text messages may be delayed or not received. Neither we nor any of our third-party service providers nor any mobile carrier shall have any liability for any delayed or undelivered text message.

Your Responsibilities

  • Subscribers assume all responsibility for ensuring compliance with University requirements, regardless of message delivery.
  • Text messages from us will be presented on your mobile device in the same manner as any other text message. Third parties can send text messages disguised as alerts from us and, therefore, it is your responsibility to independently verify the authenticity of any message that you receive. You agree to safeguard the mobile device you use to receive any Messaging Service, including to lock your mobile device with a password, if this is a feature on your device, and to delete stored text messages to/from us. You agree to assume full responsibility for the security and confidentiality of your mobile device, phone number, and passwords.

E-Sign Consumer Disclosure and Consent

This Electronic Signature (“E-Sign”) Consumer Disclosure (“Disclosure”) is provided pursuant to the federal Electronic Signatures in Global and National Commerce Act (“E-Sign Act”) and applies to all electronic records, signatures, and transactions related to the Messaging Services.

Please read the information below carefully and thoroughly. By proceeding forward and acknowledging this Disclosure you agree that you (1) have reviewed the following consumer disclosure information; and (2) consent to (a) transact business using electronic communications,  (b) receive updates, notices, disclosures, and other information in an electronic form, and (c) utilize electronic signatures in lieu of using paper documents. 

You are not required to receive certain notices and disclosures or sign certain documents electronically. If you prefer not to do so, you may request to receive paper copies and withdraw your consent at any time as described below.

  • Your consent applies to any and all electronic records, including but not limited to, notices, disclosures, agreements, statements, and electronic signature documents provided in relation to the Messaging Services. You may at any point withdraw your consent by following the procedures described below.

  • You agree that we may provide these electronic records to you via the Messaging Services, our websites, or other electronic means. You are responsible for maintaining a valid and current phone number and other contact information to ensure timely access to electronic communications from Barry.

  • You are not required to receive certain notices or disclosures or sign certain documents electronically and may request paper copies of certain documents or disclosures if you prefer to do so. You also have the ability to download and print any open or signed documents sent to you electronically using your browser’s download or print icons or commands. If you wish to receive paper copies in lieu of certain electronic documents, you may request paper copies from us by following the procedures outlined below. Fees may apply depending on the volume of the request.

  • You may withdraw your consent to receive electronic notices, disclosures, and electronic signature documents in relation to the Messaging Services at any time. In order to withdraw consent, you must notify the “sending party” that you wish to withdraw consent and that you want the “sending party” to provide in a paper format your future documents, notices, and disclosures in relation to the Messaging Services. By withdrawing consent, it will slow the speed at which we can complete certain steps in transactions with you and deliver the Messaging Services to you because we will first need to send the required notices or disclosures to you in paper format, and then wait until we receive back from you your acknowledgment of your receipt of such paper notices or disclosures. After withdrawing consent, if at any point in the future, you proceed forward and provide your electronic signature through a Barry website, including but not limited to barry.edu and any extensions or subdomains thereof (“Website”), you will once again be consenting to receive certain notices, disclosures, or documents electronically. You may withdraw consent to receive such electronic notices and disclosures and electronic signatures by following the procedures described below. To request paper copies of documents; withdraw consent to conduct business electronically and receive certain documents, notices, or disclosures electronically or sign certain documents electronically; or to update your contact information, please contact the “sending party” by emailing privacy@barry.edu

  • Using electronic signatures and receiving and saving any document or communication electronically requires a standards-compliant web browser that supports the HTTPS protocol, HTML, and cookies, as well as local, electronic storage capacity to retain your electronic documents and/or a printer to print them. If you are using a mobile or handheld device, in addition to the above requirements, it will be your responsibility to have and maintain up-to-date software on your device that allows you to print and save the electronic documents presented to you.

  • By visiting a Website, checking an online form’s box(es) or selecting an online form’s radio button(s) indicating that you give your consent and/or agree to these Messaging Terms & Conditions, and submitting the online form, you confirm that you have read, understood and consent to the terms of these Messaging Terms & Conditions, including the terms of this Disclosure.

Changes and Updates

We may change or update these Messaging Terms & Conditions at any time. Any changes and updates become effective upon publication. Your continued use of any Messaging Service constitutes agreement with these Messaging Terms & Conditions and any changes and updates.
