Drug Violations

Policy

Barry University condemns the possession, use or distribution of illicit drugs and the abuse of drugs/substances, whether prescriptive or non-prescriptive. Any student found to be in the possession of, using, selling, trading, or offering for sale illicit drugs or alcohol on University's property or as part of the University's activities will be subject to disciplinary action as well as applicable local, state, and federal laws.

The Department of Housing and Residence Life will conduct random searches in all residence halls in conjunction with our local law enforcement department.

Enforcement

The enforcement of violations of the Student Code of Conduct with regard to drugs will be addressed through the University’s’ student conduct process. The following may be used as a general guideline regarding possible sanctions which may be applied to students who have been found responsible for violating the university drug policy:

  1. First Violation
    • Housing probation
    • Community Service 10 hours
    • Fine $350
    • Parental notification
    • Reference to Counseling Center
    • University Warning
  2. Second Violation
    • Housing Termination
    • Community service 10-15 hours
    • Educational Assignment
    • Fine $450
    • University Probation
  3. Third Violation
    • University Suspension

Federal laws governing the privacy of student records, The Family Educational Rights and Privacy Act (FERPA) (20 U.S.C. § 1232g; 34 CFR Part 99) permits colleges and universities to inform the family of a student under 21 years of age when their student has been found in violation of University alcohol or drug rules and/or in the case of a health or safety emergency.
